1. Acknowledgement of Risk
I acknowledge that the Cape to Glen (hereafter “the Event”) is an extreme endurance ultramarathon covering approximately 214 miles along and associated with the Cape Wrath Trail in the Scottish Highlands.
I understand that the Event takes place in remote, mountainous and exposed environments where access to assistance may be limited and where participation involves significant inherent risks including, but not limited to:
- Falls, slips, trips and collisions;
- Difficult, uneven, rocky, boggy, wet or unstable terrain;
- Mountain, coastal and wilderness hazards;
- River crossings and water hazards;
- Severe weather conditions, including rain, wind, heat, cold, snow, ice and poor visibility;
- Navigation errors and becoming lost;
- Fatigue, exhaustion and sleep deprivation;
- Dehydration, hyponatraemia, hypothermia, heat illness and other medical conditions;
- Delayed access to emergency or medical services;
- Serious injury, permanent disability or death.
I understand these risks and voluntarily choose to participate.
2. Fitness and Medical Condition
I confirm that:
- I am physically and mentally fit to participate;
- I have undertaken sufficient training and preparation for an event of this nature;
- I have disclosed any relevant medical conditions requested by the Cape Wrath Ltd (hereafter the “Organiser”);
- I will not participate if I am suffering from illness, injury or any condition that may place myself or others at risk.
3. Personal Responsibility
I acknowledge that participation is undertaken at my own risk and that I am responsible for:
- My own safety and wellbeing;
- Carrying all mandatory equipment specified by Cape Wrath Ltd;
- My hydration, nutrition and self-care;
- Following the Event Rules and all instructions issued by Event Officials, Marshals, Medical Personnel and Emergency Services;
- Respecting the Scottish Outdoor Access Code, local communities, landowners and the natural environment.
I understand that Event Officials may withdraw me from the Event if, in their reasonable opinion, my continued participation would create an unacceptable risk to myself or others.
4. Medical Assistance
I authorise Cape Wrath Ltd, its representatives, medical personnel and emergency responders to administer or arrange emergency medical treatment if considered necessary.
I understand that emergency evacuation or treatment may involve delays due to the remote nature of the Event.
5. Release of Liability
To the fullest extent permitted by law, I agree that Cape Wrath Ltd, its directors, employees, contractors, volunteers, sponsors, event partners, landowners and agents shall not be liable for any loss, damage, expense, injury or claim arising from my participation in the Event, except where such liability arises from negligence or any other liability except where such liability cannot legally be excluded.
6. Personal Property
I understand that Cape Wrath Ltd accepts no responsibility for loss, theft or damage to personal property, equipment, vehicles or belongings brought to or used during the Event.
7. Photography, Video and Media
I grant Cape Wrath Ltd the unrestricted right to use photographs, video recordings, audio recordings and other media containing my image, voice or likeness for promotional, marketing, editorial and event-related purposes in any media worldwide without compensation.
8. Data Protection
I understand that personal information provided in connection with the Event will be processed by Cape Wrath Ltd for event administration, safety, emergency response and legal compliance purposes in accordance with applicable UK data protection legislation.
9. Limitation
Nothing in this Declaration seeks to exclude or limit liability for:
- Death or personal injury resulting from negligence;
- Fraud or fraudulent misrepresentation; or
- Any liability that cannot be excluded or restricted under applicable law.
