1. Acceptance of Terms
By submitting an entry, participants agree to be bound by these Terms and Conditions together with:
- Event Disclaimer
- Mountain Environment and Self-Sufficiency Declaration
- Mandatory Kit Requirements
- Race Rules
2. Eligibility
Participants must:
- Be physically and mentally capable of participating.
- Meet any qualification requirements specified by the Cape Wrath Ltd (hereafter the “Organiser”).
- Provide accurate registration information.
The Organiser reserves the right to refuse or cancel an entry where eligibility requirements are not met.
3. Participant Responsibility
Participants are responsible for:
- Ensuring they are adequately trained.
- Carrying mandatory equipment.
- Following the Event Rules.
- Acting responsibly towards fellow participants, volunteers, landowners and members of the public.
4. Event Changes
The Organiser reserves the right to:
- Amend the route.
- Alter cut-off times.
- Modify event procedures.
- Delay, suspend or cancel the Event.
Such decisions may be made due to weather, safety concerns, access restrictions, emergencies or circumstances beyond reasonable control.
5. Safety
The Organiser may remove any participant from the Event where, in the reasonable opinion of Event Officials:
- The participant presents a risk to themselves or others.
- Mandatory equipment requirements are not met.
- Event Rules are breached.
- Medical personnel advise withdrawal.
Such decisions are final.
6. Entries
Entries are personal and non-transferable unless expressly authorised by the Organiser.
Unauthorised transfers will result in disqualification.
7. Withdrawal Policy
Participants who withdraw must notify the Organiser as soon as possible.
Deferrals, transfers and refunds are subject to the published Event Refund, Deferral and Transfer Policy.
8. Refund Policy
Please see the Organisers specific Refund, Deferral and Transfer Policy.
9. Cancellation of the Event
If the Event is cancelled due to circumstances beyond the reasonable control of the Organiser, including but not limited to:
- Severe weather
- Natural disasters
- Public health emergencies
- Government restrictions
- Land access issues
the Organiser shall not be liable for participants' travel, accommodation or associated costs.
The Organiser may offer a partial refund, transfer or deferral at its sole discretion.
10. Results and Awards
The Organiser's decisions regarding:
- Timing
- Results
- Rankings
- Awards
shall be final.
11. Photography and Media
Participants grant the Organiser permission to use photographs, video and audio recordings taken during the Event for promotional and commercial purposes without compensation.
12. Personal Data
Participant information will be processed in accordance with the Organiser’s Privacy Policy.
13. Limitation of Liability
Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Any liability which cannot lawfully be excluded.
Subject to the above, liability shall be limited to the amount of the participant's entry fee.
14. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by the laws of England and Wales.
If any dispute arises in connection with these Terms and Conditions or the Event, the parties agree that the courts of England and Wales shall have jurisdiction.
